This Privacy Policy explains how Musaic Labs Inc. (doing business as Deep Noise) collects, uses, and shares information about you when you visit or use deepnoise.ai, aisynthesizer.com, app.deepnoise.ai, app.aisynthesizer.com, and the AI Synthesizer VST plugin (collectively, the Services).

Controller. For GDPR/UK GDPR, the data controller is Musaic Labs Inc., 1111B S Governors Ave STE 7436, Dover, DE 19904, USA. We operate the Services under the Deep Noise brand.

Covered properties: deepnoise.ai, aisynthesizer.com, app.deepnoise.ai (Deep Noise Studio), app.aisynthesizer.com (AI Synthesizer web app), and the AI Synthesizer VST plugin.

By visiting the Website, or using any of our Services, you agree that your personal information will be handled as described in this Policy. Your use of our Website or Services, and any dispute over privacy, is subject to this Policy and our Terms of Service, including its applicable limitations on damages and the resolution of disputes. The Deep Noise Terms of Service are incorporated by reference into this Policy.

This Policy is effective as of the date specified above. We reserve the right to revise this Policy periodically, so please revisit it occasionally. Any modifications to this Policy will be posted on our Website and Application. In the event of substantial changes that significantly impact our handling of the personal information we've gathered from you previously, we will make reasonable efforts to notify you in advance. If you decide to join our marketing messages campaign, we will collect your e-mail.

When you use our service we collect your input and service use history.

VST telemetry. The VST plugin may send device type, OS version, app version, crash logs, and feature events to our analytics provider. No content of your audio projects is collected by analytics.

Session Cookies: Session cookies exist only during an online session and disappear from your device when you close your browser or turn off your device. We use session cookies to uniquely identify you during a session or while you are logged into the Website and Services. This allows us to process your online transactions and requests and verify your identity as you navigate our Website and Services after logging in.

Persistent Cookies: Persistent cookies remain on your device after you close your browser or turn off your device. We use persistent cookies to track aggregate and statistical information about user activity.

Do Not Sell or Share. We do not sell personal information for money. If we use any technologies that constitute “sharing” for cross-context behavioral advertising, you can opt out via the “Do Not Sell or Share My Personal Information” link in our footer.

Authorized agents. You may use an authorized agent to submit a request on your behalf. We may require proof of authorization and verification of your identity.

Non-discrimination. We will not discriminate against you for exercising any CPRA rights.

  • When it's necessary to fulfill the contract we are entering into or have already entered into with you.

  • When it aligns with our legitimate interests, which includes our commercial interests in managing the Deep Noise customer-facing platform. We ensure that we carefully assess and balance any potential adverse effects on you and your rights before processing your personal data.

California Privacy Rights under California’s Shine-the-Light Law

Under California’s “Shine the Light” law (Cal. Civ. Code § 1798.83), California residents who provide us certain personal information are entitled to request and obtain from us, free of charge, information about the personal information (if any) we have shared with third parties for their own direct marketing use.  Such requests may be made once per calendar year for information about any relevant third party sharing in the prior calendar year. California residents who would like to make such a request may submit a request in writing to support@deepnoise.ai. The request should attest to the fact that the requester is a California resident, and provide a current California address.

Businesses subject to CCPA who process the personal information of 4 million California consumers are required to make available certain statistical information about the number of privacy rights requested to receive.

8. NOTICE TO NEVADA RESIDENTS

Although we do not currently conduct sales of personal information under the meaning of Nevada state privacy law, Nevada residents may submit a request directing us to not sell personal information we maintain about them if our practices change in the future.   • You have the right to correct inaccuracies in personal data.
  • You have the right to data portability (i.e., easy, portable access to all pieces of personal data held by a company).

The Services are not intended for children under 13 (or older where local law applies). We do not knowingly collect personal data from children. If you believe a child has provided personal data, contact privacy@deepnoise.ai and we will take appropriate steps.
